Liability Waiver, Release and Assumption of Risk
Last updated 11 October 2026 (version 2026-10-11b)
Draft. A licensed attorney reviews this before MILO opens to the public.
In short
- Strength training has real risks, from strains to serious injury. You take on those risks.
- You give up the right to sue MILO and your coach for injuries caused by ordinary carelessness. This doesn't cover gross negligence or deliberate harm.
- You check every load, use safe technique and equipment, and stop if something hurts.
- Please read it carefully: it affects your legal rights.
Please read carefully
This document affects your legal rights. By agreeing, you give up the right to bring certain claims. If you are under 18, your parent or guardian agrees for you and for themselves.
Who this protects
"Released parties" means BUILT BY MILO, LLC, a Florida limited liability company (Built By Milo, "MILO") and its owners, employees and contractors, and each coach who coaches you through MILO, together with that coach's business, staff and assistants.
"Training" means any exercise you do using MILO, or programmed, logged or discussed in MILO, whether you train alone, with your coach, at a gym, at school or anywhere else.
The risks of training
I understand that training, including weightlifting, strength and conditioning, plyometrics, running, sprinting, conditioning circuits and timed workouts, has risks. These include:
- muscle strains, sprains, tendon and ligament tears, joint, back and neck injuries, and broken bones;
- injuries from dropped or falling weights, equipment that breaks or is set up wrongly, or other people nearby;
- overexertion, dizziness, fainting, heat illness, dehydration and rhabdomyolysis (muscle breakdown);
- heart attack, stroke and, rarely, permanent disability or death;
- risks from training without supervision, misunderstanding a program or video, or a load, number or instruction in MILO being wrong, out of date, or not shown because of a software or connection problem.
I accept these risks
I train voluntarily. I know and accept all the risks of training, the ones listed above and ones not listed, including risks caused by the ordinary carelessness of a released party.
My responsibilities
- Warm up, use good technique, and use spotters, collars and safety equipment where they are needed.
- Check that equipment is in good condition and set up correctly before I use it.
- Check every load and number before I lift it, and choose a lighter weight if anything seems wrong.
- Train within my ability, stop if I feel pain, dizziness or unusual symptoms, and get medical help when I need it.
- Follow my coach's instructions and the rules of the place where I train.
- Tell my coach about injuries or conditions that affect my training.
Release of claims
To the fullest extent the law allows, I release the released parties from, and agree not to sue them over, any claim for injury, illness, death, or damage to property that comes from my training or my use of MILO, including claims caused by a released party's ordinary negligence.
This release does not cover gross negligence, reckless or deliberate misconduct, or anything the law does not allow to be released.
Emergency care
If I am injured or ill while training with my coach and can't decide for myself, I agree that my coach may call emergency services and arrange first aid or medical care for me. I am responsible for the cost of that care.
Athletes under 18
If the athlete is under 18, I am their parent or legal guardian. I have read this document, I agree to it for the athlete and for myself, and I release the released parties from claims I could bring myself because of the athlete's training, to the extent the law allows. I understand that if a court decides a parent cannot release a minor's claims where we live, the athlete still accepts the risks of training as described here.
How long this applies, and the rest
This document applies to all my training while I use MILO, and keeps applying to that training after I stop. If any part of it can't be enforced, the rest still applies, and that part is limited only as much as needed. It is governed by the laws of the State of Florida.
